Terms and conditions

The terms and conditions of business determine the terms of purchase in the online store www.sleep-nest.com . With the terms and conditions of business, we try to make your purchase easier and increase your satisfaction when using the products. We also allow you to return the products if you are not satisfied with them. The deadline for returning and exchanging the product is 14 days from the date of purchase .

1. Right to withdraw from the contract

The consumer ( the above applies exclusively to natural persons who acquire the item for purposes outside their gainful activity) has the right to withdraw from the sales contract or purchase for any reason, in accordance with the applicable legislation of the Consumer Protection Act, within 14 days to notify us that they withdraw from the contract, without having to state the reason for their decision. You can send the notice of withdrawal by e-mail to info@sleep-nest.com. The 14-day period begins on the day the consumer receives the goods.

If the consumer has already received the goods and withdraws from the contract, he/she shall send them immediately or no later than 14 days after the notification to the address below (at the end of point 1). The consumer shall be deemed to have returned the goods on time if he/she sends them before the expiry of the 14-day return period. In the event of such withdrawal from the purchase, the consumer shall only be liable for the reduced value of the goods due to handling of the goods that is not strictly necessary to determine their nature, properties and functioning. When returning products, in accordance with the provisions of the aforementioned law, the consumer shall not incur any additional costs other than the cost of directly returning the goods. The product must be returned unwashed and packed in the original packaging. The consumer may not use the items freely until withdrawal from the contract.

Before deciding to withdraw from the purchase, the consumer may inspect and test the product to the extent strictly necessary to determine the actual situation. The consumer may not continue to use the product until withdrawal from the purchase. Any "testing" and other use that deviates from the above may be considered use of the goods, which means that the consumer is liable for the reduction in the value of the goods if the reduction is the result of conduct that is not strictly necessary to determine the nature, properties and functioning of the goods. In this case, the packaging must remain undamaged and usable for the resale of the product. The received products must be returned undamaged and in the same quantity, unless the product is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The notice of withdrawal or the product is deemed to have been sent on time if the shipment is delivered within the deadline.

The consumer must return the goods together with all the accompanying documentation. In the event of a return of goods, we will refund the purchase price as soon as possible, but no later than 14 days after receipt of the returned goods, except in the case of payment by card, if it has not yet been debited. In the event of withdrawal from the contract where a discount code or promotional code has been redeemed, these funds are considered as a discount and are not returned to the user. Only the amount paid is returned to the user.

In sales contracts, the company may withhold the refund of payments received until the return is received.

The company returns the received payments to the consumer using the same payment method as the consumer used, unless the consumer has explicitly requested the use of another payment method and the consumer does not incur any costs as a result.

Withdrawal from the contract is not possible for goods:

  • for goods or services whose price depends on market fluctuations over which the company has no influence and which may occur within the withdrawal period;
  • for goods that are manufactured according to the consumer's precise instructions and adapted to his personal needs;
  • for goods that are not suitable for return due to their nature, are perishable or have a short shelf life;
  • for the service provided, if the company fully fulfills the contract and the provision of the service began on the basis of the consumer's express prior consent and with the consent that he loses the right to withdraw from the contract when the company fully fulfills it;
  • sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer has opened the seal after delivery;
  • goods which, by their nature, are inseparably mixed with other items;
  • digital content that is not delivered on a tangible medium, if the provision of the service has begun on the basis of the consumer's express prior consent and acquiescence.

2. Non-conformity of goods

When can a lack of conformity of goods be claimed?

  • if the product does not have the properties necessary for its normal use or for marketing;
  • if the product does not have the properties necessary for the specific use for which the buyer is purchasing it, but which were known to the seller or should have been known to him;
  • if the product does not have the properties and characteristics that were explicitly or tacitly agreed upon or prescribed;
  • if the provider has delivered a product that does not match the sample or model, unless the sample or model was shown only for the purpose of notification.

Product suitability check

The suitability of the product is checked with another, flawless product of the same type, as well as with the manufacturer's statements or information on the item itself.

Liability for non-conformity of goods

The seller is liable for any non-conformity of the goods at the time of delivery. The seller is not liable for any non-conformity of the goods if the consumer has been specifically informed that an individual property of the goods deviates from the objective requirements for conformity and the consumer has expressly and separately accepted this deviation (used goods or opened packaging).

Exercising rights arising from non-conformity of goods

The consumer (natural person) may exercise his rights arising from non-conformity if he notifies the seller of the non-conformity within 15 days from the day on which the non-conformity was established. The consumer must notify the provider of the non-conformity, together with a detailed description of it, and at his own expense, within the legally prescribed period. The consumer must allow the provider to inspect the product. If the existence of non-conformity of the goods is disputed, the seller shall notify the consumer thereof in writing within eight days of receiving the claim.
Shipping costs are always covered by the sender, unless otherwise agreed in advance. We do not accept COD shipments.

3. Contract and order with payment obligation

The product price, VAT value and shipping costs are visible in the shopping cart before you complete your order. You will be notified of all information about your online order to the email address you provided in the shopping cart when entering your details. If you do not receive this, there is a possibility that you have provided the wrong email address. In such a case, please contact us at info@sleep-nest.com .

The purchase contract is concluded between the buyer and the provider when the buyer makes a purchase on the website www.sleep-nest.com and receives an electronic confirmation from the provider to his/her email address. From this moment on, all prices and other conditions are fixed and apply to both the provider and the consumer.

The provider undertakes to provide the buyer with the following information when purchasing the product:

  • corporate identity
  • contact addresses that enable fast and efficient communication (email, telephone)
  • essential characteristics of goods or services
  • delivery information and product availability
  • clearly marked prices

4. Complaints and information

In the event that the goods are defective, the consumer may make a complaint about the goods. The returned goods must be clean, undamaged, without stains and in the original packaging, otherwise the provider is not obliged to accept them and they will be returned to the consumer at the sender's expense. Product returns are made by the Slovenian Post or another selected courier. The return of the product must be announced in advance by phone or WhatsApp number +386 41 392 995. We will send you a complaint report, which we ask you to fill out in full, as it represents a key document for the successful resolution of the complaint and is a mandatory part of the returned shipment.

5. Cancellation of order before delivery

In case of an error when ordering products via www.sleep-nest.com The buyer can cancel the order by calling the phone or WhatsApp number +386 41 392 995 or in writing to the e-mail address: info@sleep-nest.com .

6. Failure to receive the ordered shipment

When the consumer places an order, we process it and send it to the GLS courier service via the partner company Speedy Box doo, which the consumer is notified of at the e-mail address entered when confirming the order. If the courier cannot deliver the package to the consumer in person, he will leave a notification in the mailbox about the received shipment. With this notification, the consumer can pick up the package at a parcel terminal within 15 days. After the 15-day waiting period has expired, GLS will return the package to our address, which will incur additional costs. If the consumer does not receive a notification about the received shipment for any reason, they should inform us at info@sleep-nest.com and we will provide the details for picking up the package. Failure to pick up the package within the specified waiting period is not considered a withdrawal from the contract, as it is still validly concluded. If the consumer does not pick up the package, the next time they have the option of paying only by paid pro forma invoice or by credit card, within eight days of receiving the offer. Unfortunately, payment upon receipt will no longer be possible.

7. Products out of stock

In exceptional cases, it is possible that one of the products is no longer in stock, which will be visible on the product itself. If you would like to know when the product will be back in stock, please contact us at info@sleep-nest.com .

You cannot order a product that is out of stock through the online store.

8. Offers and promotions

Current offers and promotions are only valid in the online store www.sleep-nest.com . Discounts and various promotions cannot be combined.
